NYSEIA Comments on Proposed Rulemaking on Unregulated Battery Storage Devices in New York City

On October 1st, 2025, NYSEIA submitted comments supporting the Fire Department of New York's proposed rulemaking on unregulated storage batteries.
In the comments, NYSEIA supports the regulation of uncertified lithium-ion batteries, particularly those used in powered mobility devices, which have caused major safety risks and fires. NYSEIA makes the case that these batteries are inherently different from those used in energy storage systems, as those components are UL certified and comply with multiple safety standards as required. Unregulated batteries have also halted progress in advocating for energy storage systems in New York City, and NYSEIA urges the City to ensure UL-listed energy storage systems have a feasible permitting pathway in the future.
